1. Our Services
Tokoyo is a personal travel atlas. You can record trips by country, city and dates, view your travel history on an interactive map with statistics such as countries visited and days spent in each, add photos to your trips, and check visa requirements and days used in visa-free zones such as the Schengen Area. The Services are currently free.
The Services are not intended for use in any jurisdiction where that use would be contrary to law. If you use the Services from outside Canada, you are responsible for complying with local laws.
2. Accounts
You can browse the map without an account. Saving trips, photos and passports requires signing in with Google. You agree that the information associated with your account is accurate and that you will use only your own account.
You are responsible for keeping your Google account secure and for all activity under your Tokoyo account. If you believe your account has been accessed without your permission, tell us immediately. We are not liable for losses caused by your failure to keep your sign-in credentials secure.
3. Your data
You own the trips, photos, passports and other information you enter into the Services ('Your Data'). You give us a limited, non-exclusive licence to store, process, resize and display Your Data only as needed to provide the Services to you. Your Data is private to your account and is handled as described in our Privacy Policy.
You can edit or delete Your Data in the app at any time, or ask us to delete your account. We back up our systems, but you are responsible for keeping your own copy of anything important. To the extent permitted by law, we are not liable for loss or corruption of Your Data.
You are responsible for the photos you upload. We do not review them, but we may remove any content, or suspend your account, if we reasonably believe it breaches these Terms or the law.
4. Intellectual property
We own or license all rights in the Services, including the software, design, text, graphics and the Tokoyo name and logo, apart from Your Data and the third-party content described in section 7. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the Services for your personal, non-commercial use. All rights not expressly granted are reserved.
5. Feedback
If you send us feedback or suggestions about the Services, you grant us a perpetual, irrevocable, worldwide, royalty-free licence to use them for any purpose without paying or crediting you. Please do not send feedback you consider confidential.
6. Prohibited activities
You agree not to:
- use the Services for any unlawful purpose or in breach of these Terms;
- upload photos or other content that you do not have the right to share, that infringes anyone's intellectual property or privacy rights, or that is unlawful, sexually explicit, or depicts violence or the exploitation of minors;
- scrape, crawl or bulk-extract data from the Services, including map, city and visa data, or use bots or other automated means to access them, except for standard search engine indexing;
- attempt to gain unauthorised access to the Services, other users' accounts, or our systems, or circumvent any security or access controls;
- interfere with, disrupt or place an undue burden on the Services or their networks, including by uploading viruses or malicious code;
- decompile, reverse engineer or copy the Services' software, except where the law permits;
- impersonate another person or create accounts by automated means or under false pretences;
- resell, sublicense or commercially exploit the Services, or use them to build a competing product; or
- remove any copyright, licence or other proprietary notices.
7. Third-party services and content
The Services rely on third-party services, such as Google for sign-in, and may link to third-party websites. We do not control and are not responsible for third-party services or websites; their own terms and privacy policies apply.
Credits. Visa requirement data is adapted from the 'Visa requirements for [nationality] citizens' articles on Wikipedia, by Wikipedia contributors, licensed under CC BY-SA 4.0. The data has been parsed and reformatted, is provided for general information only, and that adapted data is available under the same licence. City data is derived from GeoNames, licensed under CC BY 4.0. Country boundaries are from Natural Earth (public domain), via world-atlas. The map is rendered with MapLibre GL JS and deck.gl.
8. Privacy
Our Privacy Policy explains how we collect and use personal information, and forms part of these Terms. The Services are hosted in the United States, so your information will be processed there, as described in the Privacy Policy.
9. Travel, visa and immigration information
Any visa, entry-limit, stay-duration or 'days remaining' information shown in the Services (including calculations for zones such as the Schengen Area) is an estimate based only on the data you enter and simplified rules, and is for personal reference only. It may be incomplete, out of date or inaccurate. For example, zone membership is applied at the country level and does not account for territories, exemptions, bilateral agreements, residence permits or individual circumstances. It is not legal or immigration advice. You are solely responsible for checking entry requirements and permitted stays with the relevant government authorities before and during travel. We are not liable for any refusal of entry, fines, deportation, overstay penalties or other consequences of relying on this information.
10. Changes and availability
We may change, suspend or discontinue all or part of the Services at any time. We do not guarantee that the Services will always be available or error-free, and we have no obligation to provide support or updates. Where reasonably possible, we will give notice of changes that significantly affect you, such as discontinuing the Services, so you can retrieve Your Data.
11. Term and termination
These Terms apply for as long as you use the Services. You can stop using the Services at any time and ask us to delete your account by emailing us. We may suspend or terminate your access, or delete your account, if you breach these Terms, if required by law, or if we discontinue the Services. If we terminate your account for breach, you may not create a new account without our permission. Sections 3 to 5 and 9 to 20 survive termination.
12. Disclaimer
THE SERVICES ARE PROVIDED 'AS IS' AND 'AS AVAILABLE'. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES, OR ANY MAP, STATISTIC, VISA OR STAY INFORMATION IN THEM, WILL BE ACCURATE, COMPLETE, UNINTERRUPTED, SECURE OR ERROR-FREE.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW: (A) WE AND OUR DIRECTORS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, REVENUE OR DATA, ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF (OR INABILITY TO USE) THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES; AND (B) OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES IS LIMITED TO THE GREATER OF CA$50 AND THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow certain warranties or liabilities to be excluded or limited, so some of the above may not apply to you. Nothing in these Terms limits any rights you have under consumer protection laws that cannot be waived by contract.
14. Indemnification
You agree to indemnify and hold harmless IZANAMI LABS and its officers, employees and agents from any third-party claims, losses and reasonable costs (including legal fees) arising from your breach of these Terms, your violation of any law, or your violation of the rights of a third party. We may take control of the defence of any such claim at your expense, and you agree to cooperate with us. You may not settle any such claim without our written consent.
15. Governing law and disputes
These Terms are governed by the laws of Canada, without regard to conflict-of-law rules. Before bringing a claim, you agree to contact us first so we can try to resolve the dispute informally. If it is not resolved within 60 days, you and we agree that the courts of Canada have exclusive jurisdiction, except that we may bring proceedings in the courts of the country where you live. If you are a consumer, nothing in this section takes away the protection of the mandatory laws of the country where you live, or your right to bring proceedings there.
16. Electronic communications
You agree to receive communications from us electronically, by email or through notices in the Services, and that these satisfy any legal requirement that communications be in writing.
17. Accessibility
We aim to make the Services accessible to everyone and work towards the Web Content Accessibility Guidelines (WCAG) 2.2, Level AA. If you have difficulty using the Services or have suggestions for improving accessibility, email tokoyoapp@gmail.com.
18. California users
Under California Civil Code Section 1789.3, California users are entitled to this notice: the Services are provided by IZANAMI LABS, contactable at tokoyoapp@gmail.com. The Services are currently free. If a complaint is not resolved to your satisfaction, you can contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834, or by phone at (800) 952-5210 or (916) 445-1254.
19. Changes to these Terms
We may update these Terms from time to time. We will change the 'Last updated' date above, and if the changes are material we will tell you by email or by a notice in the Services before they take effect. By continuing to use the Services after the changes take effect, you agree to the updated Terms.
20. Miscellaneous
These Terms, together with the Privacy Policy, are the entire agreement between you and us about the Services. If any provision is found unenforceable, it will be limited to the minimum extent necessary and the rest will remain in effect. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our written consent; we may transfer them to a successor of our business. We are not liable for delays or failures caused by events beyond our reasonable control. Nothing in these Terms creates a partnership, joint venture, employment or agency relationship.
